Where the Seller is unable to determine whether any Supplies are the Supplies in respect of which the Buyer’s right to possession has terminated,the Buyer shall be deemed to have sold all Supplies of the kind sold by the Seller to the Buyer in the order in which they were invoiced to the Buyer.
The Buyer acknowledges that all Intellectual Property Rights in the Supplies sold under these terms and conditions and any associated documentation (and any modifications thereof) are,as between the Buyer and the Seller,vested,and shall remain vested,in the Seller.The Buyer undertakes to execute any deeds and documents and do anything the Seller may require to vest all such Intellectual Property Rights in the Seller or its nominees.
