Nevertheless,the Seller is not governed bythose testing results made at request of IMSBC Code (Size,TML,FMP…) which arein conflict with rejection limits mentioned in the contract therein.Therefore,the Seller is free from any contract obligations (waiting time of the vessel,deadfreight of the vessel,cost and expenses incurred to the vessel due toshipment non-performance or late performance…) due to contract late performanceor non-performance because of non-conformity quality reason.
