Should the seller fail to make delivery on time as stipulated in Clause 5 of this Contract,with exception of force majeare causes specifield in Clause 15of this Contract,the buyer shall agree to postpone the delivery on the condition that the seller agrees to pay a liquidated damage which shall be deducted by the buyer from the payment.the liquidated damages ,howere,shall not exceed 5% of the total value of the goods involved in the late delivery.
