If a Notice in Writing is not given under paragraph 1 within the required time,
the parties may refer the unresolved dispute to the courts or to any other form
of dispute resolution,including arbitration,which they have agreed to use.
If neither party,by Notice in Writing given within 10 Working Days of the date of
Notice in Writing requesting arbitration in paragraph 1,requires that a dispute be arbitrated immediately,all disputes referred to arbitration as provided in paragraph 1 shall be held in abeyance until
Substantial Performance of the Work;
The Contract has been terminated; or
The Construction Manager has abandoned the Work.
whichever is earlier,and consolidated into a single arbitration under the rulesgoverning the arbitration under paragraph 1.
