在谓句为is现在式的情况下, 为什么前面的定语用 had laid不用has laid?

为什么前面的定语用 had laid不用has laid?--> "has laid" is correct.That NCE2 question is wrong.
This one is correct:"The food that had been laid out for the dead WAS thrown into a river or into the sea."
