Notwithstanding anything contained in theTechnical Specifications
13.1 the Supplier warrants to deliver allequipment and materials under this Contract in accordance with theSpecifications free of any visible or invisible defect,in the manner of goodworkmanship and quality using proper material,and suitable for the intendedpurpose.
13.2 The Supplier shall execute all such workof repair,amendment,reconstruction,rectification and making good defects,imperfections,shrinkages or other faults as may be required of the Supplier inwriting by the Engineer and/or the Contractor during the Warranty Period,orwithin fourteen (14) days after its expiration,as a result of an inspectionmade by or on behalf of the Engineer and/or Contractor prior to its expiration.
All such work shall be carried out by theSupplier at his own expense unless he can prove to the satisfaction of theEngineer that such work was not due to the use of materials or workmanship notin accordance with the Contract,or to neglect or failure on the part of theSupplier to comply with any obligations,expressed or implied,on theSupplier's part under the Contract.If in the opinion of the Engineer,suchnecessity shall be due to any other cause,the value of such work shall beascertained and paid for as if it were additional work.
Clause 14 PATENT RIGHTSAND ROYALTIES
The Suppliershall save harmless and indemnify the Contractor from and against all claimsand proceedings for or on account of infringement of any patent right,design,trade mark or trade name or other protected right in respect of any equipmentor materials used for or in connection with the performance of the Work andfrom and against all claims,demands,proceedings,damages,cost,charges andexpenses whatsoever in respect thereof or in relation thereto.
