摘 要
20世纪80年代以后,随着中国政治经济体制改革的不断深入,非营利组织也得到了迅速地发展.这些广泛活跃于政府与企业之间的社会组织,在各个领域所起到的作用日渐突出.
非营利组织是作为与政府、企业相对应的一种社会组织类型而存在的.它们分别对应三个独立的社会生活空间,即公共领域、市场和公民社会,彼此是合作、平等与相互制衡的关系.非营利组织的基本职能是防止国家权力破坏个人权利和弥补政府、企业在满足社会需要方面的不足.但是,与发达国家不同,我国非营利组织是改革的产物,存在的时间还很短,在组织结构、财政状况、人员构成、职能作用等方面都有自身的特点,并形成了非常独特的“官民二重性”特征.对这一特征作历史、客观、全面的剖析,可以为逐步认识和解决对它们的有效监管问题提供理论基础.
“官民二重性”作为内涵丰富的概念,意味着组织的构成具有“半官半民”的“二元结构”；组织的行为受到“行政机制”和“自治机制”的“双重支配”；组织的运作往往依赖“官方”和“民间”的“双重渠道”去获取“体制内”和“体制外”的“两种资源”,以满足“社会”和“政府”的“双重需求”.因而,组织的活动领域也只能是“社会”和“政府”共同认可的“交叉地带”.
“官民二重性”既是造成现阶段我国非营利组织特殊性的主要原因,又是对其特点最精确的概括.
